People and relatives raised no concerns around how they consented to care.

Leaders were unable to demonstrate they understood the process to follow where people were unable to consent, they were unable to tell us they would follow the correct processes. The provider told us they had sent consent forms to relatives for people who lacked capacity to make their own decisions. Staff told us they had received training in this area. They were able to tell us how they would gain verbal consent from people.

There were capacity assessments in place for people when needed, however, these had not always considered all areas. There was not always evidence to show how decisions had been made in people’s best interests. When people lacked capacity to make decisions, relatives were consenting on their behalf without the legal powers to do so. For example, in relation to the use of CCTV in the home.
